In brief

The same national law applies in Porto as in Lisbon: the same purchase process, the same 7.5% IMT for non-residents from 25 May 2026, and the same obligation to state in the deed whether the property has a título urbanístico. The differences are municipal: in Porto's five historic parishes the quota for new Alojamento Local registrations is zero, save for exceptions approved by the mayor, and prices are lower than in Lisbon. The choice between the two cities therefore starts with the intended use of the apartment, not with price alone.

Key takeaways

  1. 1Under Regulamento n.º 1462/2024, in the parishes of Miragaia, Santo Ildefonso, São Nicolau, Sé and Vitória the quota for new AL registrations is zero, except for exceptions expressly approved by the mayor.
  2. 2According to INE, the median in the Porto Metropolitan Area in the second quarter of 2026 was EUR 2,669 per sq m. In the Municipality of Porto itself, the median for buyers resident in Portugal exceeded EUR 3,500 per sq m.
  3. 3Buyers not resident in Portugal paid a median of EUR 3,640 per sq m in the Porto Metropolitan Area, compared with EUR 2,648 for residents.
  4. 4In an old building in the centre, check the título urbanístico, the exemption for pre-1951 buildings and a possible pre-emption right of public bodies in a rehabilitation area or protected area.
  5. 5Taxes are identical to Lisbon: 7.5% IMT for a non-resident, 0.8% stamp duty and annual IMI at a municipal rate.

What should be checked legally before buying an apartment in Porto?

In Porto, as in Lisbon, the first legal question is what may be done with the apartment: live in it, let it long-term or rent it to tourists. Next come the permit status, especially in the old buildings of the historic centre, pre-emption rights and taxation of non-residents. National law is identical in both cities, but the municipal regulations differ.

The general process is described in the guide to the purchase process in Portugal, and the parallel guide for the capital is the guide to buying an apartment in Lisbon.

How much does an apartment in Porto cost?

According to INE data published on 23 October 2026, the median price of apartments sold in the Porto Metropolitan Area in the second quarter of 2026 was EUR 2,669 per sq m, above the national median of EUR 2,445. In the Municipality of Porto itself prices are higher: according to the same release, the median for buyers resident in Portugal in the year ending June 2026 exceeded EUR 3,500 per sq m, and 4,268 transactions were recorded in the city over that period.

For Israelis, the gap by the buyer's place of residence also matters: in the Porto Metropolitan Area, buyers not resident in Portugal paid a median of EUR 3,640 per sq m, compared with EUR 2,648 for residents. These are transaction prices, not listings, but they are still averages across very different areas. The total cost can be calculated with the acquisition cost calculator.

Lisbon

Lisbon or Porto: what are the legal differences?

Most of the rules are identical, and the differences are concentrated in AL, prices and the tourist tax. The table summarises the position as of November 2026:

TopicLisbonPorto
Purchase processNIF, CPCV, escritura and registrationIdentical
IMT for a non-resident on a residential propertyFlat 7.5%Identical
AL regulationAmended RMAL, in force since 6.12.2025Regulamento n.º 1462/2024
Containment zonesBased on the ratio of AL to permanent dwellings; absolute containment in six central parishesFive historic parishes, quota of zero new registrations
Transfer of an existing AL registration in a containment zoneGenerally lapses on transferCheck the regulation and with the municipality before signing
Municipal tourist taxEUR 4 per night, up to 7 nightsEUR 3 per night, up to 7 nights
Median price (INE, Q2 2026)EUR 5,299 per sq m in the Municipality of LisbonEUR 2,669 per sq m in the Porto Metropolitan Area

The practical conclusion: anyone planning tourist rental in the historic centre will not find an easier solution in Porto than in Lisbon. For anyone planning to live in the apartment or let it long-term, the main difference is price and neighbourhood.

Can an apartment in central Porto be rented to tourists?

In the historic parishes, as a new registration, almost never. Under Regulamento n.º 1462/2024, published in December 2024, the parishes of Miragaia, Santo Ildefonso, São Nicolau, Sé and Vitória are containment zones, and the quota for new registrations in them is zero, except for exceptions that require express approval by the mayor and a prior inspection. Outside these zones, registration is made by prior notice to the municipality, which may object.

Buying an apartment with an existing AL registration?

Check in the RNAL that the registration is active, which parish the apartment is in, what the municipal regulation provides on the transfer of a registration, and what the condominium regulations permit. Do not pay a premium for an "AL licence" before checking that it will pass to you.

On operating obligations, insurance, guest reporting and the taxation of AL and long-term leases, see the guide to renting out property in Portugal.

An old building in Porto: permits, renovation and pre-emption rights

A large share of apartments in central Porto are in old buildings, so the permit review is at the heart of the transaction. From 1 October 2026, the deed of sale must state whether the property has a título urbanístico, and a deed that does not state this is exposed to annulment. The use permit itself has not been mandatory at signing since 2024, but banks usually ask for it.

  • A pre-1951 building: a building constructed before the General Building Regulations entered into force in August 1951, and not altered since, is exempt from a use permit, subject to recognition by the municipality.
  • Planned renovation: in Porto's historic centre, which is recognised as a World Heritage Site, works may be subject to conservation restrictions. Check what is permitted before the CPCV.
  • Public pre-emption right: a classified property, or one in a protected area or an urban rehabilitation area, may be subject to a pre-emption right of the municipality, the State or the heritage authority. The seller publishes a notice on Casa Pronta, and the bodies have ten working days to respond.
  • Existing tenant: a tenant who has lived in the apartment for more than two years is, as a rule, entitled to a pre-emption right, with 30 days to respond.
  • The condominium: debts to the condominium and decisions on works that may bind you.

How much tax does an Israeli buying an apartment in Porto pay?

Since 25 May 2026, a buyer not resident in Portugal pays a flat 7.5% IMT on a residential property under Decreto-Lei 97/2026, plus 0.8% stamp duty. The difference compared with the standard table can be refunded if you become resident in Portugal within two years, or if you let the apartment as a residence within six months of the purchase, at a rent of up to EUR 2,300 per month, for at least 36 months within the first five years. IMI is paid every year based on the registered value, and on a sale half of the gain is taxed in Portugal, with a credit in Israel under the tax treaty. Details in the guide to real estate taxation in Portugal.

What does the purchase process in Porto look like in brief?

  1. NIF through an attorney-in-fact, and opening a bank account with a source-of-funds check.
  2. Document review: land registry, tax registration, permits, AL, tenants and condominium.
  3. CPCV with a deposit. A buyer in breach forfeits it, and a seller in breach returns it in double.
  4. Payment of IMT and stamp duty before signing.
  5. Signing and registration via escritura, an authenticated document or Casa Pronta.
  6. Tax representative or sign-up for electronic notifications within 15 days.

From Israel, you sign by power of attorney at the Portuguese consulate, or before an Israeli notary with an apostille and a certified translation. And for those asking whether the apartment will confer status: buying real estate does not today confer a Golden Visa; see the guide to residency and citizenship in Portugal.
