Website of Ilan Leibovitch & Co. Law Office - leibovitch.co.il
1. General
This website (the “Site”) is operated by Ilan Leibovitch & Co. Law Office, managed by Adv. Ilan Leibovitch (the “Firm”).
These Terms govern the use of the Site and its content. Browsing the Site, using it, reading its content and submitting details through it constitute full acceptance of the terms set out here. Anyone who does not agree to these Terms is asked not to use the Site.
Any reference in these Terms to one gender is for convenience only and applies equally to all genders.
The Site’s Privacy Policy and Accessibility Statement form an integral part of these Terms.
2. Nature of the content on the Site - not legal advice
The content published on the Site - including articles, guides, country pages, tax and regulatory reviews, posts, videos and any other content - is general information only, intended to broaden the reader’s knowledge.
This content does not constitute legal, tax, financial or investment advice, and is no substitute for individual advice given by a qualified professional familiar with the specific circumstances of each case.
Every overseas real estate transaction is affected by individual factors: the buyer’s tax status, the holding structure, the sources of financing, the country and city in which the property is located, and the identity of the counterparty. Two transactions that appear similar may lead to entirely different legal and tax outcomes.
3. Use of the Site does not create a lawyer-client relationship
The mere use of the Site, reading its content, completing a contact form, subscribing to the mailing list or sending a message to the Firm does not create a lawyer-client relationship between the user and the Firm.
A lawyer-client relationship will be created only after it has been confirmed that there is no conflict of interest, and after a written fee agreement has been signed between the parties.
The Firm may, at its sole discretion, decline to take on an inquiry, among other reasons on grounds of a conflict of interest, workload or lack of professional fit, and is not obliged to give reasons for doing so.
Confidential or sensitive information should not be sent through the Site before a lawyer-client relationship has been established. Information sent at this early stage is not necessarily protected by lawyer-client privilege, although the Firm keeps it confidential as set out in the Privacy Policy.
4. Currency of information and information on foreign law
The Firm makes every effort to ensure that the information on the Site is accurate and up to date as at the date of publication. However, much of the content concerns foreign law, tax regimes, investment incentives and regulatory arrangements in various countries - areas that change frequently, sometimes at short notice, and sometimes at the level of the local authority rather than at national level.
Accordingly, information appearing on the Site should not be relied upon without verifying that it is current as at the time the decision is made, and without obtaining individual advice.
The Firm does not warrant that all content on the Site reflects the most current legal position, and assumes no obligation to update content published in the past.
5. No offer, solicitation or promise of returns
Nothing on the Site constitutes an offer, solicitation or recommendation to purchase a property, invest in a project or enter into any transaction.
Examples, scenarios, case studies and data appearing on the Site are for illustration only. They do not constitute a promise or representation as to any return, profit, appreciation in value or other outcome. Investing in real estate, and particularly in real estate overseas, involves risk, including the risk of losing part or all of the investment.
6. Intellectual property
All intellectual property rights in the Site and its content, including texts, articles, design, logo, the Firm’s name, trademarks, images, videos, source code and structure, belong to the Firm or to third parties that have granted the Firm a license to use them.
The Site’s content, in whole or in part, may not be copied, reproduced, distributed, published, broadcast, translated, used to create derivative works or put to any commercial use without the Firm’s prior written consent.
Short extracts from the Site’s content may be quoted for the purposes of study, criticism or review, provided that full attribution is given to the source, including the Firm’s name and a link to the original page.
7. Prohibited uses
The Site may not be used for any unlawful purpose or in breach of these Terms. Among other things, it is prohibited to:
- Interfere with the proper operation of the Site, its servers or its security.
- Use automated tools to collect content or data from the Site (scraping, crawling, harvesting), except with prior written approval.
- Use the contact details appearing on the Site to send unsolicited commercial mailings.
- Impersonate any other person or entity when contacting the Firm through the Site.
- Upload or send through the Site any content that is offensive or misleading, or that infringes the rights of a third party.
8. Third-party links and content
The Site may include links to external websites, including the websites of authorities in the target countries, professional publications and social networks. These links are provided solely for the user’s convenience.
The Firm has no control over the content, availability or policies of these websites and is not responsible for them. The inclusion of a link does not constitute a recommendation or endorsement of the content to which it refers.
9. Availability of and changes to the Site
The Firm may, at its sole discretion and without prior notice, change the structure of the Site, its content and the scope of the services offered through it, and may suspend its operation, whether temporarily or permanently.
The Firm does not warrant the uninterrupted availability of the Site and is not responsible for interruptions, technical faults or disruptions arising from communications infrastructure, service providers or force majeure.
10. Limitation of liability
Use of the Site and its content is at the user’s sole risk.
The Firm, its partners, employees and anyone acting on its behalf shall not be liable for any damage, whether direct or indirect, pecuniary or non-pecuniary, including loss of profit or loss of opportunity, caused to the user or to any third party as a result of using the Site, relying on content published on it, or being unable to use it.
For the avoidance of doubt, this limitation of liability relates solely to the use of the Site. It does not derogate from the Firm’s professional liability towards clients who have engaged it under a fee agreement, which is determined by the engagement agreement and by the law applicable to lawyers in Israel.
11. Indemnity
A user who breaches these Terms or uses the Site unlawfully shall indemnify the Firm for any damage, loss, expense or payment it incurs as a result, including legal fees and litigation costs.
12. Privacy
The collection, use and safeguarding of information on the Site are subject to the Site’s Privacy Policy, which forms an integral part of these Terms. We recommend that you read it carefully.
13. Mailing list and advertising
E-mail newsletters are sent only to people who gave explicit consent by ticking an unticked consent box, in accordance with section 30A of the Communications (Telecommunications and Broadcasting) Law, 1982. Each mailing is marked as advertising where required, includes the office details and a simple unsubscribe option, and you may unsubscribe at any time.
14. Accessibility
The Firm works to make the Site accessible in accordance with the Equal Rights for Persons with Disabilities Law, 5758-1998 and the regulations promulgated under it. Full details appear in the Site’s Accessibility Statement. Any user who encounters difficulty in using the Site is welcome to contact us, and we will act to respond.
15. Changes to these Terms
The Firm may update these Terms from time to time. The binding version is the version published on the Site at the time of use, and the date of the latest update appears at the top. Continued use of the Site after an update constitutes acceptance of the updated version.
16. Governing law and jurisdiction
These Terms and any matter arising from them shall be governed exclusively by the laws of the State of Israel, without regard to international conflict-of-laws rules.
The competent courts of the Tel Aviv-Jaffa district shall have sole and exclusive jurisdiction over any dispute relating to the Site or to these Terms.
