In brief
A guaranteed return on property abroad is not a feature of the property, but a contractual undertaking by a particular entity, and it is worth exactly as much as that entity's ability to pay on the day payment falls due. Before relying on it, you check who gives the undertaking and what assets they have, what security stands behind it, whether the guarantee is built into the purchase price, and what happens to the property and the management agreement when the term ends. According to a 2022 staff position of the Israel Securities Authority, a fixed payment that does not depend on the unit's income is also one of the signs that the transaction is in substance a financial investment.
Key takeaways
- 1"Guaranteed" means someone has given an undertaking. Check who, and what assets they have, not only the amount.
- 2An undertaking by a special-purpose company with no assets is worth little. A bank guarantee, a registered charge or an escrow account adds substance.
- 3A fixed return is sometimes paid back out of the price you paid. Compare the price per sq m with similar units without a guarantee.
- 4Just as important: what happens at the end of the term, and whether you can leave the management agreement and let or sell on your own.
- 5How the payment is classified for tax, rent or something else, depends on the structure. Check with an accountant in advance.
- 6According to the Israel Securities Authority, a fixed payment that does not depend on the unit's income is a sign of a financial investment, which may be a security.
"A guaranteed 6% return for five years", "guaranteed rent from day one", "the company will rent the apartment from you". Phrases like these recur in the marketing of property abroad, mainly in holiday apartments, hotel units and off-plan projects. They give a sense of certainty, and sometimes they are indeed properly backed. But legally, "guaranteed" is just a word. What matters is who gave the undertaking, for what, and what happens if they do not pay.
This guide explains what usually lies behind a guaranteed return or guaranteed rent, which documents to ask to see, and which questions to ask before signing. It does not decide whether a particular guarantee is good or bad, but how to check it. The information is correct as of November 2026.
What is a guaranteed return on property abroad?
It is an undertaking by a particular entity to pay you a fixed amount, usually a percentage of the purchase price, for a defined period. It comes in several forms:
| Form | How it works | What to check |
|---|---|---|
| Lease-back | The developer or a management company rents the unit from you at a fixed rent and operates it | Who the tenant is, what assets they have, and whether the lease is registered or binds a future buyer |
| Income guarantee in a management agreement | The management company lets to others and undertakes to pay you a minimum | What happens when income falls below the minimum, and who pays the difference |
| Discount or refund on the price | The developer pays you back part of the price each year and presents it as a "return" | Whether the full price is above market, and what happens after the term |
| Return in a company or on a loan | You lend to or invest in a company, and it undertakes to pay interest or profit | Here you have not bought a property. It is a financial obligation, and may be a security |
What they all have in common: the source of payment is another entity, not the property itself. So the guarantee is worth exactly as much as that entity.
Who guarantees the return, and what stands behind them?
This is the first question, and the answer must be written in the contract, not the presentation. Developers usually operate through a special-purpose company for each project. If the undertaking is given by such a company, its only asset may be the project itself, and when the project is in difficulty, so is the guarantee.
- Who signed? The name of the company giving the undertaking, its registration number, and whether it is the same company selling you the property.
- What does it have? Financial statements, assets, debts and legal proceedings, according to the companies register and the courts portal in the country.
- Is there a guarantee from another party? A parent-company guarantee, a personal guarantee from the controlling shareholders, or a bank guarantee.
- Is there security? A charge registered in your favour, an escrow account in which the guaranteed amount is deposited, or insurance.
- What will it be paid from? From the property's income, from the guarantor's own capital, or from new buyers' money. A payment unconnected to the property's income needs an explanation.
A bank guarantee is usually the strongest protection. In Romania, for example, such a guarantee is an irrevocable and unconditional undertaking by the bank, but the law does not require it, so it is a matter for negotiation, as explained in the guide to payment protection in Romania. Check the term, the amount and the conditions for calling it: a guarantee that covers only the first year out of five does not protect the whole promise.
The US regulatory organisation FINRA warns that a seller cannot guarantee a particular return, and that you should be especially wary of promises of high returns when market yields are much lower. The warning was written about debt instruments, but the principle is the same: a guarantee is as good as whoever stands behind it.

Is the guaranteed return built into the price of the apartment?
Often, yes. If the unit is sold at a higher price than similar units without a guarantee, part of the "guaranteed" return may in fact be a refund of money you paid. The check is relatively simple: compare the price per sq m with transactions in similar units in the same area, and calculate what the return would be without the guarantee, based on real market rent.
Another question is what the property will be worth at the end of the guarantee period. A future buyer will pay according to the income the property generates in the market, not according to the guarantee you received. On prices that look too good, see a bargain property deal abroad: opportunity or trap.
What happens when the guaranteed rental period ends?
This is the part least talked about in marketing, and it determines the real value of the property. Check:
- Does the management agreement continue? Sometimes the guarantee ends, but the management agreement continues for a long period and obliges you to stay with the same company, on its terms.
- Can you leave it? On how much notice, and with what penalty.
- Can you let the property yourself? In a hotel unit or a resort complex, private letting may be prohibited or impractical.
- Is there a rental licence? In Greece, for example, short-term letting requires a registration number, and in some areas the registration does not pass to the buyer. See the guide to short-term rental in Greece.
- Can you sell? Transfer restrictions, a developer's right of first refusal, or a management agreement that passes to the buyer and deters them.
In Bulgaria, for example, the management agreement in a gated residential complex is registered against each unit and also binds subsequent buyers, as explained in the guide to resort properties in Bulgaria. In Romania there is no regulation of property management companies, so everything depends on the agreement, as explained in the guide to a property management agreement.
When does a guaranteed return turn the deal into a security?
When in substance the transaction is a passive investment rather than the purchase of a property you control. In a staff position from February 2022, the Israel Securities Authority described real estate ventures abroad in which, in its view, the agreements were securities, even though the units were registered in the investors' names. Among the signs it listed: a fixed annual payment derived from the amount invested and not dependent on the unit's income, a long-term lease-back to the developer, a buy-back at a pre-set price and a uniform price for all units.
What this means for the investor: such an offer to the public in Israel requires a prospectus or compliance with one of the exemptions. If it was marketed widely without a prospectus, that is a sign the deal was not checked from this angle. On the rules, see raising money from Israelis and the Securities Law.
How is a guaranteed return taxed in Israel?
It depends on the substance of the payment. An Israeli resident is taxed on worldwide income. When the developer rents the unit from you, the payment is usually rental income, and for rent from a residential property abroad you can choose, subject to conditions, the 15% track under section 122A of the Income Tax Ordinance or marginal tax with a credit for the foreign tax. When the unit is part of a hotel, or the payment is in substance interest or a refund of the price, the classification may be different, and the cost of the property for capital gains tax on a sale may also be affected.
The payment is also taxed in the country of the property, sometimes by withholding. Check the classification and the track with an accountant before signing, based on the actual contract. The principles are gathered in the guide to the Israeli side of property abroad.
What are the red flags in a guaranteed return?
- The guarantee appears in the presentation but not in the contract, or in a separate contract with another company.
- The party giving the undertaking is a new company with no assets and no financial statements.
- There is no bank guarantee, charge or escrow account.
- The return is much higher than market rent in the same area.
- The price per sq m is higher than similar units without a guarantee.
- There is no way to leave the management agreement at the end of the term.
- The first payments arrive on time, but it is unclear where the money comes from.

How do we check a guaranteed return clause?
We read the undertaking in the contract and the management agreement, check the guarantor and the security in the registers, mark the gap between the presentation and the documents, and check what happens at the end of the term and on exit. Where needed, we negotiate a bank guarantee, security or a right to leave the management agreement. We carry out the local checks with lawyers licensed in the country of the property, and coordinate the tax question with your accountant.

Frequently asked questions
Is a guaranteed return on property abroad really guaranteed?
It is guaranteed only in the sense that someone has undertaken to pay. Its value depends on the guarantor's ability to pay, and on the security behind it. An undertaking by a special-purpose company with no assets is very different from a bank guarantee.
What is the difference between guaranteed rent and a guaranteed return?
With guaranteed rent, someone rents the property from you or undertakes to pay income from it. A "guaranteed return" can also be a refund out of the price, interest on a loan or profit in a company. What matters is what the contract says, not the label.
What happens if the developer stops paying the guaranteed return?
It depends on the contract: whether there is a guarantee or security that can be enforced, and whether you can terminate the management agreement and let the property yourself. Without security, what remains is a claim against the company that gave the undertaking, sometimes in another country.
How do you know if the guaranteed return is built into the price?
Compare the price per sq m with transactions in similar units in the same area without a guarantee, and calculate the return based on market rent. A significantly higher price may indicate that part of the return is a refund of your own money.
Is an investment with a guaranteed return a security?
It may be. According to a 2022 staff position of the Israel Securities Authority, a fixed payment that does not depend on the unit's income, a lease-back to the developer and a buy-back at a fixed price are signs of a financial investment, even when the unit is registered in the investor's name.
How is guaranteed rent from abroad taxed in Israel?
For rent from a residential property, you can usually choose between the 15% track under section 122A and marginal tax with a credit for the foreign tax. When the payment is in substance interest or a refund of the price, the classification may be different. Check with an accountant before signing.
