Title Deeds in Cyprus: The Problem of Stuck Deeds and How to Protect the Buyer

Why thousands of Cyprus buyers still lack a Title Deed, what the 2025 law changed, and which checks and contract clauses protect you when buying from a developer.

In brief

A title deed (Title Deed) in Cyprus is the certificate of registration issued by the Department of Lands and Surveys, and only it transfers full ownership. In new projects the separate deed for each apartment is issued only after a completion certificate, division of the plot and the consent of the developer's bank - so many buyers have remained for years without a deed. Practical protection is a combination of advance checks, depositing the contract at the registry, an arrangement with the encumbering bank and a payment structure that leaves the buyer with leverage until registration.

Key takeaways

  1. 1A separate title deed is issued only after a completion certificate for the building, division of the plot and the consent of every bank holding a mortgage on the land.
  2. 2The main cause of stuck deeds is the developer's mortgage on the land, alongside building violations that prevent a completion certificate.
  3. 3Law 110(I)/2025 opens a route for long-standing buyers, but applies only to old contracts. A new buyer needs to protect himself in the contract and at the registry.
  4. 4Since December 2023 the seller must attach a current search certificate to the contract, and there is a declaration mechanism of the encumbering bank (Type A) that defines how much must be paid to release the apartment.
  5. 5In an apartment without a separate deed, the payment structure and the deposit of the contract matter no less than the price.

What is a title deed (Title Deed) in Cyprus?

A title deed is the certificate of registration (Certificate of Registration) issued by the Cyprus Department of Lands and Surveys (DLS) under the Immovable Property Law, Cap. 224. Only such a registration in your name confers full legal ownership. As long as there is no deed in your name, you have a contractual right - important and protected, but not ownership.

This distinction is decisive in Cyprus more than in other markets, because a large part of new apartments are sold before a separate deed exists for them. Most residential buildings and neighborhoods are built on a single "parent" plot that is registered in the developer's name, and sometimes mortgaged to his bank. An apartment in such a building is, at this stage, an undivided share in the plot - not a registered unit.

The main cause of stuck deeds is the developer's mortgage on the land, alongside building violations that prevent a completion certificate.

Key takeaways

Why are so many properties in Cyprus without a deed?

For a separate certificate of registration to be issued for an apartment, three conditions must be met: a completion certificate for the building under the Streets and Buildings Regulation Law (Cap. 96), the consent of every bank holding a mortgage on the land, and survey and division work on the plot. If even one is missing - the deed gets stuck.

In practice, the recurring reasons are:

  • Building violations: the building was built differently from the permit - an enclosed balcony, a floor, additional area - so no completion certificate was granted.
  • Planning conditions not carried out: roads, parking or infrastructure that the developer undertook to complete with the local authority and did not complete.
  • The developer's mortgage: the bank that financed the project refuses to release the apartment as long as the loan has not been repaid, even if the buyer paid the full price.
  • Insolvency: the developer collapsed before submitting an application for division, or the application was simply never submitted.

The scale of the problem is considerable. According to data presented to the House of Representatives in May 2025, 5,417 buyers remained without a deed mainly because of missing permits, and 4,080 buyers who had paid the full price could not receive a deed mainly because of developers' mortgages. The Ministry of Interior reported in June 2025 on 9,497 applications by "trapped buyers" that were frozen.

What happened to the "trapped buyers" law and what changed in 2025?

In 2015, Law 139(I)/2015 was enacted, which allowed a buyer who had paid the full price to approach the registry and receive the property in his name even where the land is mortgaged to the developer's bank. On 20 June 2024 the Court of Appeal (Civil Appeal 285/2018) held that the central provisions of the law were unconstitutional, because they infringed the bank's property rights. Thousands of applications remained pending.

In response, the House of Representatives approved on 25 June 2025 Law 110(I)/2025, published on 4 July 2025. Its main points:

  • The law applies to contracts entered into and deposited at the registry by 31 December 2014, or to contracts entered into by 31 December 2024 and deposited by court order, where the court application was filed by that date.
  • Where there is an encumbrance that preceded the deposit of the contract, the consent of the encumbrancer must be obtained. If it refuses and the buyer paid the full price, one may apply to the court within 45 days of the refusal and request an order determining that the refusal is not justified.
  • A balance of the price not yet paid is deposited in a trust account of the registry within 60 days of the Director's notice.
  • In old applications that do not yet have a separate deed, the deed must be issued within two years and eight months, and the buyer is given eight months to submit technical documents.
What this means for today's buyer

The 2025 law was designed to solve the "old stock". It does not apply to someone who signs a contract today. A new buyer must build his own protection - through checks, the contract and the registry.

How do you check whether a property has a deed, and what does it reveal?

The basic tool is a search certificate (Search Certificate) from the DLS, which shows in whose name the property is registered, whether it has a separate registration, and which mortgages, attachments, deposited contracts or restrictions are registered against it. It can be ordered at a district lands office or online through the DLS portal. According to the official fee schedule, the fee is EUR 10 per district or authority, and EUR 20 for a search across the whole island. Cyprus has no owners' registry open to the public, and the information is given only to someone with an interest - an owner, a prospective buyer, a lender or a lawyer on their behalf.

Since the 2023 amendment to the Specific Performance Law, for contracts signed from 12 December 2023, the seller must attach to the contract a search certificate dated no more than five working days from the date of signing. A seller who does not do so is exposed to an administrative fine of up to EUR 10,000, and even criminal liability. This is an excellent tool, but it shows only the status of the registration. It does not reveal building violations, planning conditions not completed or the developer's financial condition.

What checks must you carry out when buying an apartment without a separate deed?

  1. A search certificate for the parent plot: who the registered owner is, which mortgages are registered and in favor of which bank, and whether there are attachments or earlier deposited contracts on the same unit.
  2. Planning permit and building permit: make sure they are valid, that they match what was actually built, and that the permit conditions do not impose open obligations.
  3. Completion certificate (Certificate of Final Approval): in a completed building - whether it was granted. In a building under construction - what the conditions are for the timetable, and what happens if it is not granted.
  4. Division application: whether it was submitted to the registry. Since 2 January 2024 the registry accepts a division file only when all the documents in it are complete.
  5. The position of the encumbering bank: whether the bank is willing to sign a declaration (Type A) that defines an amount on payment of which the apartment will be released.
  6. The developer's history: how long it took him to issue deeds in previous projects, and whether he has lawsuits or insolvency proceedings.

What is Type A, and how does it protect against the developer's mortgage?

Type A is a written declaration by the encumbering bank and the seller, which the buyer signs confirming he has read, in which a fixed amount is set: if the buyer pays it into the seller's bank account specified in the declaration, the bank will issue a payment confirmation and release the apartment from the mortgage. The 2023 amendment provided that where the only encumbrances on the property are a mortgage or a deposited contract, deposit of a new contract will be accepted only with a Type A declaration, or with a declaration by the buyer (Type Γ) that he asks to deposit without it.

After payment, the bank issues a payment confirmation (Type B). If the bank does not act to release the property, and the buyer presents such a confirmation signed and bearing the bank's stamp, the Registrar may transfer the property into the buyer's name. In other words: Type A turns the developer's mortgage from an open problem into a known amount. A buyer who waives it by signing a Type Γ needs to understand clearly what he is giving up.

How do you build a contract that protects the buyer until the deed is received?

In an apartment without a separate deed, the contract is the main protective tool, and it has several components worth insisting on:

  • Payments by milestones: tying the payments to verified construction progress, and not to a calendar schedule.
  • Payment to the account defined in the Type A: so that the money you pay reduces the debt that encumbers your apartment.
  • Holding back part of the price until registration: where it can be negotiated, an amount paid only upon transfer of the deed is the best leverage a buyer has.
  • A commitment to a timetable and a remedy: a date for submitting the division application and for issuing the deed, and a defined remedy if the date is missed.
  • Responsibility for building violations: an undertaking by the developer to regularize at his expense any violation that prevents a completion certificate.
  • Deposit of the contract at the registry: within six months of signing, and in practice - immediately. We expand on this in a separate article.

What about the program to regularize building violations?

In autumn 2024 the state opened a planning amnesty program that allowed owners to regularize minor violations - enclosed balconies, pergolas or small additions - for a fee, in order to allow a completion certificate and a deed. According to a June 2026 report, about 3,000 applications were submitted, and as of mid-2026 only about 20% had been processed because of overload in the local authorities. The conclusion for the buyer: do not assume that a "minor" violation will be regularized quickly. If there is a violation, it must be the developer's responsibility, with a timetable and a remedy.

Can you sell or transfer an apartment before receiving a deed?

Yes, by assignment of the contract (Assignment), in which the original buyer transfers his contractual rights to a new buyer. The assignment is deposited at the registry together with a certificate of settlement of capital gains tax. According to the official fee schedule, the fee is 0.5% of the price in the contract or in the assignment - whichever is higher - with a minimum of EUR 50 and a maximum of EUR 3,000, and only EUR 20 for an assignment between parents and children, between spouses or between relatives up to the third degree. Here too, a properly deposited contract is a condition for an orderly assignment.

The Israeli aspect: financing, reporting and the investment decision

Banks, in Cyprus and in Israel, tend to prefer a charge over a property with a separate deed, so someone who plans to refinance or mortgage the property in the future should take into account that the deed is a practical condition for this. An exit plan also depends on the deed: a sale to a final buyer is much simpler when the property is registered. For tax purposes in Israel, the date of purchase, the price and the incidental expenses need to be documented already at the contract stage, regardless of when the deed will be registered.

What to do before signing, and how we accompany you

Before signing for an apartment without a separate deed, we obtain a search certificate for the parent plot, check the permits and the status of the completion certificate, clarify the position of the encumbering bank and require a Type A where there is a mortgage, and draft a contract that ties the payments to progress and leaves the client with leverage until registration. Immediately after signing we deposit the contract at the registry, and follow the division application until the deed is registered in the client's name.

Frequently asked questions

How long does it take to receive a Title Deed in Cyprus?

For a second-hand property with an existing deed, the transfer is a matter of days to weeks. In a new project the time depends on the completion certificate, the division and the consent of the developer's bank, and in the past sometimes took years. Since January 2024 the registry accepts only complete division files, but the actual timing still depends mainly on the developer.

What is a "stuck" Title Deed?

It is a situation in which the buyer has paid, and sometimes lived in the apartment for years, but it cannot be registered in his name - because of the developer's mortgage, building violations, planning conditions not completed or the developer's insolvency.

Does the 2025 trapped buyers law apply to me?

Only if your contract was entered into and deposited by the end of 2014, or entered into by the end of 2024 and deposited by court order for which the application was filed by that date. New contracts are outside its scope, and protection for them is built in the contract and by depositing it at the registry.

Is it worth buying an apartment without a separate deed?

It is possible, and very common in new properties, provided that you check the permits and the encumbering bank, obtain a Type A where there is a mortgage, deposit the contract immediately and build a payment structure that protects you. Without these the risk is high.
